Terms of use and sale

1. Purpose and seller

These terms govern the relationship between Jules Orthion (“the publisher”, “we”) and anyone using the “Peak” service (“you”). The service is available online. Customer service contact: orthionjules@gmail.com.

2. Nature of the service

The service provides an informational, wellness-oriented estimate, along with fourteen-day behavioral programs and personalized tracking. It is neither a diagnosis, nor a treatment, nor medical advice, and does not replace a consultation. If you have any doubt about your health, consult a professional.

3. Access and account

Access requires creating an account. You agree to provide accurate information and to keep it confidential. The service is reserved for adults.

4. Prices

• Questionnaire: free.
• 3-day free trial, then a monthly subscription of $19.99 per month, or a prepaid annual subscription of $150 per year.
• Where applicable, one-time unlock of the detailed result: $2.99, single payment.

Prices are shown in US dollars (USD), tva non applicable, article 293 b du cgi, before entering the payment flow. The due date, the first charge date at the end of the trial, and automatic renewal are stated clearly before any commitment. Payment is processed by our provider Stripe; we store no card data.

5. Free trial and renewal

The free trial lasts 3 days. A card is registered from the start; no amount is charged during the trial. At its end, the subscription continues automatically at the stated price unless canceled before the due date. The subscription then renews automatically, for the same duration, until it is canceled.

6. Right of withdrawal

For content and services performed immediately (unlocking the result, immediate access to tracking), Article L221-28 of the French Consumer Code allows waiving the fourteen-day right of withdrawal by expressly requesting immediate performance. This waiver is collected via a dedicated checkbox before payment. Without it, the fourteen-day period fully applies. The free trial lets you test the service with no payment at all.

7. Cancellation

The subscription is canceled from your account, through a flow accessible in three clicks, with no email or contact with support (Articles L215-1 and L221-1 of the French Consumer Code). After cancellation, your report remains viewable read-only; tracking and protocols stop at the end of the current period. No pro-rata refund is due for a started period, unless otherwise required by law.

8. User obligations

You agree to use the service as intended, not to attempt to compromise its security, and not to provide false information likely to distort the estimates returned to you.

9. Liability

Estimates and programs are provided for informational purposes. The publisher cannot be held liable for decisions made solely on their basis, nor for temporary interruption of the service for maintenance or reasons beyond its control. Nothing herein limits the publisher's liability where the law prohibits it.

10. Personal data

The processing of your data, including your health data, is described in our privacy policy, which forms an integral part of these terms.

11. Disputes and mediation

In the event of a dispute, first contact our customer service at orthionjules@gmail.com. Failing an amicable solution, you may use a consumer mediator free of charge. In accordance with Articles L611-1 et seq. of the French Consumer Code, the publisher will join a mediation scheme whose details will be shown here before going on sale. You may also use the European online dispute resolution platform.

12. Governing law

These terms are governed by French law. They do not affect the mandatory rights that the law of your country of residence grants you as a consumer.
